These Terms govern your use of dataPalatable at app.datapalatable.ai. By creating an account or using the service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 16 years old to use the service, and at least 18 years old to enter into a paid subscription. By using dataPalatable, you represent that you meet these requirements.

2. Your account

You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Acceptable use

You agree not to:

• Use the service to violate any law or third-party right.
• Attempt to gain unauthorized access to any part of the service or other accounts.
• Run automated scraping, crawling, or load-generating scripts against the service without prior written permission.
• Submit content that is illegal, defamatory, harassing, threatening, hateful, or sexually explicit.
• Impersonate any person or entity.
• Resell, redistribute, or sublicense the service or generated outputs in a way that competes with dataPalatable.
• Reverse-engineer or attempt to derive the underlying ranking, data, or prompt-engineering logic of the service.

We may suspend or terminate your account for any violation, including a single violation we deem serious.

4. AI-generated content

dataPalatable uses third-party large language models and image-generation models to produce perspectives, comparisons, and images. These outputs are best-effort suggestions, not verified facts. Reference values come from curated data sources (SEC, World Bank, EIA, Wikipedia, IEA), but the phrasing, ratios, and visual content may contain errors. Do not rely on outputs of dataPalatable for medical, legal, financial, or other consequential decisions without independent verification.

5. Content ownership

• You own your inputs: the numbers, questions, images, and text you submit.
• You own outputs derived from your inputs (the perspectives generated for your query), subject to the AI provider terms in Section 4.
• We own the service: the engine, codebase, curated reference database, brand, and the dataPalatable mark. Nothing in these Terms grants you any right in our intellectual property except the limited license to use the service as intended.

6. Paid plans

Pro features (extended image generation, larger result limits, multi-entity questions) require a paid subscription. Billing, cancellation, and refund terms will be displayed at the point of purchase. We may change pricing with 30 days' notice; existing subscriptions are billed at the rate in effect when renewal occurs.

7. Service availability

We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages (Railway, Groq, OpenAI, etc.), and unforeseen incidents may cause temporary unavailability. See our status page for current and historical uptime.

8. Termination

You may delete your account at any time from the account settings page. We may suspend or terminate your account on notice for breach of these Terms or applicable law, and immediately without notice for severe violations.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100). IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

11. Indemnification

You agree to indemnify and hold dataPalatable Inc. harmless from any claim arising out of your use of the service, your content, or your violation of these Terms.

12. Modifications

We may update these Terms from time to time. Material changes will be announced at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

14. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the service.
